Please read these Terms of Service ("Terms") carefully before using the TikTomato platform (the "Service") operated by TikTomato ("we", "our", or "us").

By accessing or using the Service, you agree to be bound by these Terms.

1. Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old to use the Service.
• One person or legal entity may not maintain more than one account.

2. Credits and Payments

• The Service uses a credit-based system. Credits are required to generate content.
• Credits are non-refundable once purchased, except as required by applicable law.
• Some credit packages include a validity period, which is clearly displayed at the time of purchase. Credits from these packages expire after the stated period. Packages without a stated validity period do not expire.
• Free credits may be provided through promotions, sign-up bonuses, or daily check-ins. We reserve the right to modify or discontinue free credit programs at any time.
• Prices are subject to change with 30 days notice.

3. Acceptable Use

You agree not to:

• Use the Service to generate illegal, harmful, or abusive content
• Generate content that infringes on intellectual property rights of others
• Attempt to reverse-engineer, decompile, or extract AI models through our Service
• Use automated systems (bots, scrapers) to access the Service without permission
• Share or resell API access tokens
• Circumvent rate limits or usage restrictions

4. Generated Content

• Ownership — You retain rights to content you generate using the Service, subject to the underlying AI model licenses.
• License to us — You grant us a limited license to store, process, and display your generated content as necessary to provide the Service.
• No guarantee — We do not guarantee that generated content will be accurate, appropriate, or free from errors.
• Content moderation — We reserve the right to remove content that violates these Terms or applicable laws.

5. AI Model Providers

• The Service integrates multiple third-party AI models. Each model may have its own usage terms and content policies.
• We are not responsible for the output quality, availability, or content policies of third-party AI models.
• Model availability may change without prior notice.

6. API Access

• API access is provided via access tokens. You are responsible for keeping tokens secure.
• API usage is subject to rate limits. Exceeding limits may result in temporary suspension.
• We reserve the right to revoke API access for violations of these Terms.

7. Service Availability

• We strive for high availability but do not guarantee uninterrupted service.
• We may perform maintenance with or without prior notice.
• We are not liable for any loss resulting from service downtime.

8. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind.
• We are not liable for any indirect, incidental, or consequential damages.
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

• You may delete your account at any time.
• We may suspend or terminate your account for violation of these Terms.
• Upon termination, your right to use the Service ceases immediately. Unused credits are forfeited.

10. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which TikTomato operates, without regard to conflict of law provisions.
